1. Definition

In these Terms and Conditions:

Application ” means Matahari's application;
Goods ” means goods offered and sold through www.matahari.com;
Terms and Conditions ” means these Terms and Conditions, including any amendments and/or replacements thereof, which contain a set of rules governing your and Matahari's rights, obligations, responsibilities, and procedures for using the Site and Application;
Matahari ” means PT Matahari Department Store Tbk;
You ” means anyone who accesses, browses, uses, or makes a purchase on the Site/Application;
Buyer ” means a user who has an Account and makes an Order.
Account ” means the account you create on the Site and/or Application;
Working Day ” means a day other than Saturday, Sunday or National Holiday;
We ” means Sun;
Order ” means the order and purchase of goods that you make on the site and/or application;
Order Confirmation ” means the confirmation email that Matahari sends to you in which Matahari acknowledges your order in accordance with the provisions of Article 7.2 below;
Contract ” means an order for 1 (one) Goods or more as stated in the Order that Matahari receives in accordance with the provisions of Article 7.2 below;
Services ” means the content, information, services and/or functions provided on the site and/or application.


References to “section” or “clause” are to that section or clause in these Terms and Conditions; Headings or sub-headings in these Terms and Conditions are for convenience of reference and shall not affect the interpretation or construction of these Terms and Conditions. Words conveying the singular shall be deemed to include the plural and vice versa. Words conveying gender shall include any gender and references to persons or persons shall include an individual, company, corporation or partnership. References to the word “including” or similar words or expressions shall mean without limitation.

4. Matahari Rewards

GENERAL REQUIREMENTS

  1. Matahari Rewards is a Loyalty Program Membership Card in the form of a physical card and/or digital card (" Card ") issued by PT Matahari Department Store Tbk (" Matahari ")
  2. Matahari Rewards membership is open to customers who have valid and current identification and have met the Matahari Rewards membership requirements .
  3. Matahari Rewards members are fully responsible for the use of the Matahari Rewards membership card .
  4. Matahari at any time has the right to create, change, interpret, implement Matahari Rewards membership policies and mechanisms including the acquisition and/or use of Points without prior written notice.   5. By registering for Matahari Rewards membership , prospective members and/or members of Matahari Rewards understand and agree that Matahari has the right to own, store, use, destroy, manage, check the validity, provide data and information related to Matahari Rewards for the purposes of recording, analyzing, managing, displaying data of prospective or members of Matahari Rewards . Matahari Rewards Members hereby release Matahari from all risks arising in connection with the matters that have been agreed upon.
  6. Matahari has the authority to take any action against any violation of Matahari Rewards membership rules and conditions.
  7. Matahari is not responsible for (i) products or services provided or offered by partners or parties collaborating with Matahari that customers obtain as benefits or privileges of Matahari Rewards membership, and (ii) any risks arising as a result of misuse of Matahari Rewards membership .
  8. Matahari Rewards provisions are subject to the laws of the Republic of Indonesia, and are applicable and binding on all members.

SPECIAL PROVISIONS

  1. Registration and activation of Matahari Rewards Membership:
    1. There are 2 ways to become a Matahari Rewards Member:
      1. Download and register matahari app / matahari.com
      2. Make a registration at the Matahari store

With the following conditions:

      • MR Red Registration: Free
      • Automatic Upgrade to Diamond: Minimum accumulated purchases for 1 year Rp. 5,000,000,-
      • New Diamond Registration: minimum purchase of IDR 2,000,000 in one transaction receipt.
      • Upgrade from MR Red to Dimaond: minimum purchase with MR Red card of IDR 2,000,000,- in one transaction receipt.
    1. Activation of Matahari Rewards membership using OTP ( One Time Password ) containing verification code from Matahari. Activation of Matahari Rewards membership can be done through the website www.matahari.com or Halo Matahari at 1500 838 or Matahari App (can be downloaded on Play Store (Android) or App Store (IOS)) or Customer Service officer at Matahari store. If Matahari Rewards membership is NOT ACTIVATED , then Matahari Rewards membership benefits including points for purchases cannot be obtained. Shopping points are given after the activation date of Matahari Rewards membership .
  1. Matahari Rewards membership ends
    • Terminating or being dismissed from Matahari Rewards membership due to misuse and/or use of the Matahari Rewards Card that is not in accordance with the ownership and intended use of the card.
    • Matahari Rewards member passes away

Points Terms

Every minimum purchase of IDR 20,000 at Matahari and multiples thereof (rounded down) by showing the Matahari Rewards membership card will get Points according to the type of membership card:

    • RED : 100 (one hundred) Points
    • Diamonds: 200 (two hundred) Points
  1. Points will be credited within 3 (three) days from the transaction date.
  2. Payments using Points will no longer earn points.
  3. Points are valid for 6 (six) months from the date of acquisition. Points that have passed the 6 (six) month time limit (expired) cannot be used anymore (forfeited).
  4. 1 (one) Point is equivalent to Rp. 1,- (one rupiah)

Changes to Member Personal Data

Changes to personal data are made through:

  1. Nearest Matahari Customer Service
  2. Website www.matahari.com or Matahari App
  3. Hello Sun 1500838

Others

  1. Matahari Rewards membership cannot be transferred/traded.
  2. By signing the Matahari Rewards membership application form, members/prospective members hereby declare that they understand, accept, agree to and are bound by the Matahari Rewards membership terms and conditions.

5. Prohibitions

You must not misuse this website or application. While accessing, browsing or using this website or application, you are prohibited, among other things, from (a) committing or supporting criminal acts, (b) committing or supporting unlawful acts, (c) sending, spreading and/or distributing viruses in any form. Trojan horses, worms, logic bombs, (d) sending or inserting harmful material in any form to or into the website or application including harmful technology, (e) committing acts that violate the rights of any party including intellectual property rights, (f) committing the act of pretending to be another person/entity, providing information, identity or information that is false, incorrect or misleading, or using another party's data, (g) in any way carrying out actions, writing or publishing things that are false or untrue, offensive or harassing, (h) enters or gains unauthorized access and/or interferes with or disrupts computer systems or networks connected to the Application, (i) damages data, (j) causes disturbance to other users, (k) violates morality, (l) violates the rights of decency of others, (m) sends advertising or promotional materials into the Application, and/or (n) attempts to influence the performance or function of the Application, either in part or in whole. Any violation of these Terms and Conditions constitutes a criminal offense under the applicable laws in Indonesia, including Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE). If this happens, Matahari has the right to take necessary actions, including but not limited to canceling or delaying Orders and/or delivery of Goods, freezing or deleting Accounts, including reporting such violations to authorized law enforcement and taking legal action in accordance with applicable legal provisions.

6. Entire Agreement

6.1 These Terms and Conditions constitute an agreement between you and Matahari regarding the Application. You have agreed that Matahari has the right to make changes and/or replacements to these Terms and Conditions from time to time without requiring your approval or notification.

6.2 You acknowledge that in accessing, browsing, using or making a Booking on the Application, neither you nor Matahari are dependent on any statements, guarantees or promises given by Matahari or any party, whether express or implied.

6.3 By creating an Account, you hereby give your consent to Matahari to use and/or provide your information and/or data for Matahari's purposes, including for the purposes of recording, storing, analyzing, managing, and displaying your data, delivering information and/or promotions in connection with the Account, implementing cooperation with Matahari's partners, for other Matahari operational interests, or destroying your data information if necessary. This consent is given as long as you have an Account and/or browse or use the Application, and you hereby release Matahari from all risks that have or will arise in connection with the use and/or provision of your data.

7. Order Requirements

7.1 Account Creation

  • To be able to make a booking, you must create an account on the Matahari website or application.
  • You agree to provide only accurate, current, complete, correct and non-misleading data, information and statements to Matahari. You are required to keep your information up to date if there are changes to the data, information and statements you previously provided by using or through the relevant part of the Application.
  • You are responsible for all activities that occur under your Account or password. You are responsible for maintaining the confidentiality of your Account password and restricting access to your Account. Matahari reserves the right to close or deactivate Accounts and deny access to the Application to any party who violates these provisions.
  • You are prohibited from selling or transferring the Account in any way.
  • You are prohibited from creating multiple user accounts.
  • Matahari will not ask for your username or password for any reason, therefore Matahari urges you not to provide this data or other important data to parties claiming to be Matahari or other parties whose security cannot be guaranteed.
  • You agree to ensure that you log off from your Account at the end of each session and notify Matahari of any unauthorized use of your Account or password.
  • You understand and agree that you are responsible for maintaining the confidentiality of your user ID and password and agree not to provide it to anyone else. You hereby declare that Matahari is not responsible for any loss or obstacle arising from your Account whether caused by your negligence or not, including but not limited to lending or providing account access to other parties, accessing links or links provided by other parties, providing or showing passwords or emails to other parties, or other negligence on your part that results in loss or obstacles to your Account.

7.2 Ordering and Purchasing

  • To make an Order, you must follow the Ordering procedures set out on the Matahari website or application.
  • After you have made the payment and the payment has been received by Matahari, you will receive an Order Confirmation as approval of your Order[ALRN1] [NY2].
  • When placing an Order, you agree that you have read, understood and agreed to the description and price of the Goods (including but not limited to color, type of material, quality, size and others) before placing an Order. Matahari will make its best efforts to ensure that all details, descriptions and prices appearing on the Application are in accordance with the condition of the Goods. If Matahari finds an error in the details, descriptions and/or prices on the Application, for the Goods in your Order, Matahari will notify you of this as soon as possible and give you the option to reconfirm your Order with the correct details, descriptions and/or prices or cancel it. If Matahari cannot contact you, Matahari will cancel your Order.
  • Matahari reserves the right to cancel an Order if you make an Order for resale (re-seller).
  • The Buyer acknowledges that the actual color of the Goods as seen on the Application may vary. Matahari has made every effort to ensure that the colors in the photographs displayed on the Application are as accurate as possible, but cannot guarantee that the appearance of the colors on the Application will be accurate in accordance with the original colors.
  • You understand and agree that the availability of Goods stock may change. If the Goods stock is empty, Matahari may reject the Order, and payment for the Goods concerned will be returned to you.
  • Matahari has full authority to refuse payment without notice to you.
  • Payment for the Order you make must be made no later than 2 (two) [ALRN3] [NY4] [ALRN5] days after you make the Order. If within the time limit you have not made payment or confirmation of payment, Matahari has the authority to cancel the Order in question. You are not entitled to file a claim or lawsuit for the cancellation of the Order.
  • If you cancel an Order that you have paid for before the Goods are sent to you, Matahari will try to cancel the Order in the Application and refund the payment received after deducting any costs that may arise from the cancellation process.
  • You agree not to notify or submit proof of payment and/or payment data to any party other than Matahari. In the event of any loss due to notification or submission of proof of payment and/or payment data by you to any other party, then it will be your own responsibility.
  • Matahari will send your Ordered Goods to the delivery address you specify in your Order. If your Order includes more than one Goods, the Goods may be sent to you in separate packages and at separate times.
  • After receiving the ordered Goods, you are required to confirm receipt of the Goods. Matahari provides a time limit of 2 (two) days after the delivery status is "sent" on the system so that you can confirm or complain about the receipt of the Goods. If within this time limit you do not confirm or complain, then you agree to the automatic confirmation of receipt of the Goods by the system.
  • You understand and agree that Matahari is not responsible for any complaints about Goods sent after you confirm receipt of the Goods or automatic confirmation by the system of receipt of the Goods. Losses arising after confirmation/automatic confirmation of receipt of the Goods are your responsibility.
  • You understand and agree that any problem with the delivery of Goods caused by late payment is your responsibility.

7.3 Price and Payment

  • The prices listed in the Order are in Rupiah currency. By placing an Order, you agree to pay the price of the Goods, shipping costs, and other costs that may arise as will be described in detail on the payment page.
  • Matahari is not obliged to fulfill your Order if the price listed in the Application is incorrect or wrong (even after you have received confirmation of the Order).
  • You can make payment for each Order by using the services provided by one of Matahari's partners listed in this Application or using cash using the applicable delivery payment method. You can also make payment for all or part of your Order price using promotional vouchers officially issued by Matahari in accordance with applicable provisions.
  • To minimize risk, Matahari will encrypt your credit card [ALRN1] [NY2] [ALRN3] and/or debit card data. Upon receipt of your Order, Matahari will request a pre-authorization from your bank or card issuing institution to ensure that there are sufficient funds to complete the Order transaction. The Order will not be confirmed or approved or responded to until this pre-authorization check has been completed. Your card will be automatically debited once Matahari has sent you the Order Confirmation. Validation and authorization checks on your card will be performed by your bank or card issuing institution. If Matahari does not receive the necessary authorization or validation,[ALRN4] [NY5] [ALRN6] Matahari will not be liable for any delay or non-delivery of the Goods as stated in the Order.
  • If the Order and/or purchase is unsuccessful or cancelled, the bill for the Order and/or purchase will be canceled and the transaction funds will be returned to the credit card limit on the next bill. The provisions in this paragraph do not apply to transactions for purchasing goods using a credit card that violates the provisions of the law and/or the terms and conditions applicable to Matahari.
  • Upon receipt of payment authorization from your card issuer, when you click the “Order” button to make payment, you provide irrevocable confirmation and representation that you are entitled to the card, e-gift card or promotional voucher used to make the payment, and have sufficient funds or credit facilities to cover all prices and fees that you are required to pay for the Order of Goods.
  • Inventory/stock of goods in the Matahari system will be deducted after you complete the Order and receive an Order confirmation email. If before you complete the Order there is another buyer who successfully completed the transaction for the last inventory/stock of the same Goods, then the process of completing your transaction will be automatically canceled by the system.
  • Matahari may at any time hold promotional activities with terms and conditions that may vary for each promotional activity. Users are advised to read carefully the terms and conditions of the promotion.

7.4 Wrong Order

  • If you find that you have made a mistake with your Order and have entered it into the Application, please contact halo@matahari.com immediately. Matahari will try its best to make any necessary improvements or corrections to the Order error.

7.5 Rejection of Order

  • Matahari reserves the right to withdraw any Goods from and/or delete, replace, update, add, reduce, adjust, edit and/or change all materials or content in the Application including information, data and/or descriptions regarding the Goods. Matahari will make its best efforts to process each Order as long as the Order meets all Terms and Conditions. Under certain conditions Matahari may not be able to accept or further process your Order even though you have received the Order Confirmation in accordance with provision 6.2 of these Terms and Conditions.
  • If Matahari rejects, cancels or does not further process an Order that you have paid in full, then the entire payment amount will be refunded to you.

8. Delivery

  1. Matahari will send the Goods you ordered after receiving confirmation of payment and the full payment amount related to the Order in a timely manner and in accordance with the total payment amount stated in the Order.
  2. Matahari will deliver the Goods to you at the delivery address as stated in the Order. Estimated delivery time can be seen at the time of checkout of your Order. The estimated delivery time can be updated in the Order Confirmation.
  3. Matahari will try to ensure that Matahari's logistics courier partners deliver the Goods in accordance with the estimated time that has been informed, but it is understood and agreed that the estimated delivery time depends on the region and destination of delivery and the scheduling of Matahari's logistics courier partners. Matahari is not responsible for any losses, liabilities, damage costs or other costs arising from late delivery of the Goods.
  4. Any form of complaint or claim regarding the delivery of Goods is the full responsibility of the logistics courier partner working with Matahari. Matahari will try to facilitate you with the logistics courier partner working with Matahari, and in connection with this you hereby agree to release Matahari from all forms of claims, compensation, lawsuits, demands and/or losses that you suffer or experience or from all costs or expenses that you incur arising from or in connection with the delivery of Goods.
  5. After or at the time of delivery of the Goods, you may be asked to sign a proof of delivery and in such cases you are required to sign the proof of delivery. You may contact Matahari Customer Service at 021-50813024 or halo@matahari.com if there is an error, defect or damage to the Goods. You must be able to show the shipping documents for the Goods you Receive.
  6. Please be aware that it is possible that Matahari's logistics courier partners are unable or unable to deliver Goods to certain locations for certain reasons, in which case Matahari will inform you, using the contact details you provided to Matahari when making the Order, to arrange delivery to an alternative delivery address or cancel the Order.
  7. Matahari sends Goods in packaging in accordance with the packaging standards applicable at Matahari.
  8. All risks for the Goods will be transferred to you after the Goods are delivered to the address stated in the Order or to another address specified by you. On the date or time when the risk for the Goods is transferred to you as stated above, Matahari has no responsibility in any form for the Goods, including for the loss or damage of the Goods. Matahari has the right to prohibit or limit subsequent Orders that you make or make in the future if you violate the obligations in the previous Order or the Terms and Conditions.
  9. If you are not present to pick up or receive delivery of the Goods, re-delivery will be carried out in accordance with the provisions applicable to Matahari's logistics courier partners.
  10. If delivery or collection of the Goods is delayed due to refusal by you for unreasonable or unreasonable reasons or if you do not (within two weeks of Matahari's first attempt by the courier partner to deliver the Goods to you) accept delivery of the Goods or collect the Goods from Matahari's courier partner, then Matahari shall be entitled to, without affecting any other rights available to or held by Matahari, take any one of the following actions:
    1. charge you for the costs Matahari incurs; and/or
    2. does not send the Goods or does not provide the Goods for you to pick up and notify you of the Order in effect, in which case Matahari will refund the amount of money received from you as stated in the Order, minus administration fees including costs for attempted delivery, return and storage of the Goods, as well as costs arising therefrom.

9. Cancellation by you (Goods Not Damaged)

You acknowledge and agree that the condition of the Goods you see on the website or application may differ from the condition of the Goods you receive (for example in relation to the quality of color or material). If you wish to cancel your Order please contact Matahari Customer Service Team at 021-50813024 or halo@matahari.com. Unless otherwise stated in other articles in these Terms and Conditions, there is no cancellation fee. You cannot cancel after the Order has been submitted, cancellation of such Order cannot be accepted and in such case, if you wish to return the Goods, then the return of the Goods must be done in accordance with the guidelines or procedures provided by Matahari Customer Service Team.

10. Returns and Refund Policy

  1. You understand and agree that the availability of Goods stock may change at any time, so if the Goods stock is empty, Matahari will or can reject the Order as will be informed to you. Matahari will refund the payment for the unavailable Goods that you have ordered.
  2. If you are not satisfied with the Goods you received, you can return the Goods to Matahari within a maximum of fourteen (14) working days from the time the Goods are received, provided that the Goods returned have never been used, are not damaged, are not defective, are not stained, the price tag and Goods label are not damaged, are intact, there are no missing or loose parts, and the Goods must be in the original brand packaging. This policy also applies to Goods that are not listed in the types of Goods that cannot be returned as stated in the Application.
  3. Matahari provides prepaid shipping (COD) service to provide the best online shopping experience for you. Please look for the prepaid shipping label in the Goods package sent to you. If you cannot find the prepaid shipping label, contact Matahari Customer Service Team at 021-50813024 or halo@matahari.com.
  4. You can process the return of goods through the delivery service of your choice with the shipping costs borne by you.
  5. The item you returned along with the return slip that you have completed correctly will be processed after the item is received at Matahari warehouse. Your refund will be made immediately after your item is received in the conditions as referred to in article 9.2 above, and in accordance with the return method you selected on the return slip. 11. Damaged Goods

  1. All descriptions, information, data and/or materials in any form (including descriptions of Goods) posted on the website or application are provided 'as is' and without any statements, warranties or promises, either express or implied, or any hidden meaning.
  2. The image of the Item as seen on the website or application may differ slightly from the actual Item you receive.
  3. If the Goods you receive are damaged, please contact our Customer Service Team with your Order number, your name and address, details of the Goods and the reason for returning the Goods, and whether you require a return or replacement Goods.
  4. Once the Goods you return due to damage are received, Matahari will inspect them and will notify you of your right to a replacement Goods (if any) or a refund via email as soon as possible in accordance with the applicable Terms and Conditions.
  5. In the event that you return an item that is not damaged, Matahari has the right to decide not to repair the item or replace the item with a new item or refund your money. Matahari also has the right to require you to pay all costs incurred in connection with the ordering or delivery of the item to you or with the process of returning the item by you to Matahari in accordance with the applicable cost standards at that time, including but not limited to credit or debit card service fees, or all fees or payments as stated in your Order. As long as it does not conflict with applicable law, Matahari is not responsible to you for any loss or any costs, fees or expenses that you incur or pay in connection with or arising from matters as specified in these Terms and Conditions.

12. Vouchers

  1. You can use vouchers (both gift vouchers and promotional vouchers) that are officially issued or distributed when you make payment for ordering Goods on the website or application.
  2. In the event of fraudulent actions or attempts or in the event that Matahari has suspicions of or suspicions of other illegal activities related to the redemption of vouchers on the website or application, we reserve the right to close your Account at any time and/or ask you to use a different payment method. Illegal activities in question include, for example, the use of vouchers repeatedly with the same name and different emails.
  3. Matahari is not responsible for lost, stolen or illegible vouchers.
  4. For certain reasons, especially to stop misuse of vouchers and as long as it does not conflict with applicable laws, Matahari may at any time change the terms and conditions applicable to vouchers that have been given or issued to you or to stop or cancel vouchers that have been issued previously, and Matahari is not responsible for any losses arising from it. Each 1 (one) voucher issued can only be used once. If there is more than one use, Matahari can cancel the use of the voucher.
  5. Conditions for redeeming promotional vouchers. From time to time Matahari may distribute promotional vouchers that can only be used on the website or application, which are sent to you via email or post:
    1. Promotional vouchers are valid for the period stated on the voucher, can only be redeemed or used once and cannot be used together with other promotional vouchers or for discounted goods. Matahari may make exceptions to the use of promotional vouchers on certain brands of goods in accordance with Matahari's sales strategy,
    2. If you make an Order for Goods with a value less than the voucher value, then there will be no refund of the remaining voucher value that will be returned to you.
    3. promotional vouchers do not earn interest and have no cash value;
    4. If the promotional voucher value is not sufficient for your Order, you may change the payment method using one of the payment methods accepted in the Application.
    5. The voucher will be deducted when you have pressed the "Pay" button on the payment page. Matahari is not responsible for the loss of voucher value when an Order error occurs.
    6. Vouchers are not valid for re-sellers. If Matahari finds any indication of re-sellers or fraudulent attempts in the use of vouchers, Matahari has the right to cancel your transaction at any time in accordance with Article 11.2
    7. Matahari is not responsible for vouchers that are not obtained directly from Matahari.
  6. Any consequences that occur to the promotional voucher during and after the Order is not Matahari's responsibility, including if there is physical damage to the voucher, incomplete parts, a decrease in the value of the Goods or legal obligations and consequences that occur due to the Order.
  7. Vouchers cannot be traded through any media. Matahari is not responsible for any form of fraud, theft, and loss resulting from the sale or transfer of the voucher.

13. Responsibility

  1. Unless otherwise stated in these Terms and Conditions and to the extent not in violation of applicable law, Matahari expressly excludes all statements, warranties, promises, guarantees and/or other conditions that may be deemed to be given or implied by law, applicable legal provisions, customary law or general customs and is not responsible for any costs, losses or damages in any form, including but not limited to (a) direct, indirect, special and/or consequential losses, (b) losses for loss of use, profits, data or other forms, (c) losses for tarnished goodwill or reputation, or (d) costs of procuring replacement Goods, each arising from or related to the use, inability to use, performance or failure of the Application and/or any content, material, data, descriptions, images or information displayed on the Application or placed or contained in the Application.
  2. Matahari is not responsible to you or any other party for (a) inaccuracies, errors, damages or losses caused by failure, delay, (b) interruption of the Service, (c) content, materials, data, descriptions, images or information displayed on the Application or placed or contained in the Application and/or (d) use of the website or application by you or any other party. In connection with this, you agree that you cannot file any claims, lawsuits and/or demands in any form against Matahari for any losses or damages arising

14. Compensation

You are obliged and hereby agree to compensate for all losses suffered by Matahari, as well as defend and hold harmless Matahari and its directors, officers, employees, consultants, agents and affiliates from any and all (a) claims, reprimands, demands and/or lawsuits from any party in any form, (b) obligations, damages, expenses and/or costs (including but not limited to, legal fees) incurred or experienced, each in connection with or as a result of your use of this website or application or your violation of these Terms and Conditions. 15. Management guarantees and complaints

  1. Matahari will carry out its obligations as specified in the Terms and Conditions.
  2. Matahari places great value on your satisfaction. You may contact Matahari at any time at the address as stated in Article 6.4 of these Terms and Conditions. Matahari will endeavor to provide a solution to your complaint regarding the use of the Application as soon as possible and will contact you for an examination regarding the complaint in question.
  3. You are required to describe and convey the objectives of your complaint accurately and you are required to send a copy of the Order or at least the Order number and Order Confirmation. It is hereby informed that it is possible that your email may be trapped in Matahari's spam filter or not reach Matahari, or that correspondence sent to you may not be received by you. If you do not receive a response from Matahari within five (5) Business Days after Matahari received your complaint through Matahari's system, please contact Matahari again.
  4. Any disputes arising between Matahari and you will be resolved through deliberation to reach a consensus. If no agreement is reached, the settlement will be carried out through the South Jakarta District Court in Jakarta.

17. Circumstances Beyond Our Control (Force Majeure)

  1. Matahari is not responsible to you for any violation, hindrance or delay in the implementation of the Order or these Terms and Conditions by Matahari caused by force majeure or any circumstances or conditions beyond Matahari's control, including but not limited to:
    1. strike, lock-out or other industrial action;
    2. civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
    3. fire, explosion, storm, flood, earthquake, landslide, epidemic or other natural disaster.
    4. the impossibility of using trains, shipping aircraft, motorized transport or other means of transport, whether public or private;
    5. impossibility of using public or private telecommunications networks;
    6. actions, decisions, laws, regulations or restrictions of any government, shipping, postal or other transportation related strikes, failures or accidents; and/or
    7. damage to the network or computer system or internet system on the website or application.
  2. In the event that the circumstances or events as referred to in Article 16.1 above last for more than one week, either you or Matahari may cancel the Order by providing written notice and without any obligation from Matahari or Matahari may send the Goods that you have ordered and paid for but have not yet sent.
  3. If Matahari has provided confirmation of an Order for the provision of the same or similar Goods to more than one customer but Matahari is unable to fulfill its obligations to you due to the occurrence of one or more events as referred to in Article 16.1 above, Matahari has the right to decide which Orders will remain valid and which Orders will be terminated.
  4. Matahari has absolute discretion to determine the solution to be taken in fulfilling Matahari's obligations based on the Order in the event of an event as referred to in Article 17.1 above.

18. Notification

Any notice to you in connection with an Order will be given in writing either by letter or email at the last known address or email address.

  1. Notices delivered by post shall be deemed to have been received by you within two (2) Business Days from the date of posting, if your address is in Indonesia.
  2. Notices delivered via email are deemed to have been received by you within two (2) calendar days from the date the email was sent.

Any graphics, logos, page headers, icon buttons, text, or service names included in or available on the website or application are trademarks owned by Matahari or its licensors, protected by Indonesian Copyright Law and International Copyright Law. Matahari trademarks may not be used in any way and under any circumstances in connection with goods, services, products and/or other things that are not available on the Application, including in any way that is or may cause confusion among the public or any party or in a manner that disparages or discredits Matahari. All trademarks or other intellectual property rights not owned by Matahari that appear on the Application are the property of their respective owners.
  3. Matahari's status (and that each contributor is identified) as the author of content on the Application.
  4. You may not use any part of the website or application or any or all of the contents, materials, data, descriptions, images or information displayed on the Application or placed or contained in the Application for any including for commercial purposes without obtaining prior written consent from Matahari or the licensee. In the event that Matahari suspects or knows of any violation of intellectual property rights, Matahari may take legal action in accordance with applicable laws and regulations.

Matahari reserves the right to change and/or update these Terms and Conditions from time to time without prior notice. If you access, browse, and make a Booking on the website or application at a certain time, then it will be considered as acceptance of the changes and/or updates to the Terms and Conditions.
